These terms govern your use of the BrynForum managed Flarum hosting service ("the Service"), trading as BrynForum ("BrynForum", "we", "us"). By signing up for or using the Service, you ("Customer", "you") agree to these terms.
1. The Service
BrynForum provides multi-tenant hosting of the Flarum open-source forum software on shared cloud infrastructure. Each customer subscription provisions a private Flarum instance accessible at a subdomain of brynforum.com or, optionally, at a custom domain you supply.
BrynForum is independent and is not affiliated with the Flarum Foundation. "Flarum" is used as nominative fair use to describe the open-source software we host.
2. Subscriptions and billing
Subscriptions are sold on a recurring monthly basis at the tier prices published on brynforum.com. Payment is processed by Lemon Squeezy, Inc. ("Lemon Squeezy"), our merchant of record. Lemon Squeezy handles billing, applicable sales taxes (VAT and equivalents), and customer-facing invoices on our behalf.
Your subscription renews automatically until you cancel it. You can cancel at any time from your Lemon Squeezy customer portal or by contacting us.
If a recurring payment fails, we may suspend or terminate the Service after providing reasonable notice (typically 7 days) to the email address on file.
3. Refunds
See our Refund Policy. In short: full refund within 14 days of your first subscription on a tier; subsequent refunds at our discretion.
4. Acceptable use
You may not use the Service to host content or carry out activities that are:
- Illegal under the laws of the United Kingdom, the European Union, or the jurisdiction in which your forum is operated;
- Designed to harass, threaten, defame, or harm specific individuals;
- Used for distribution of malware, phishing, spam, or other abusive automated traffic;
- Infringing third-party intellectual property rights;
- Used for adult, pornographic, or sexually explicit content involving minors, or any non-consensual content;
- Configured to consume disproportionate shared resources (cryptocurrency mining, persistent abusive automation, resale of compute) to the detriment of other customers.
We may suspend or terminate accounts that breach this section. Where the breach is illegal activity, we may also report it to the appropriate authorities and retain relevant records.
5. Customer responsibilities
You are responsible for:
- The content posted by you and the users of your forum;
- Compliance with applicable laws in operating your community (including data-protection laws if you collect personal data from your forum users, copyright laws governing content shared in your forum, and any consumer-protection laws governing your relationship with your forum's users);
- Moderation of your forum and enforcing your own community rules;
- Keeping your admin credentials secure;
- Any custom domain DNS records pointing to BrynForum infrastructure.
6. Service availability
We aim to provide a reliable service and apply commercially reasonable efforts to keep the Service available. We do not currently offer a contractual service-level agreement (SLA). The Service is provided on an "as is" basis.
We perform routine maintenance, security updates, and infrastructure upgrades. These are typically transparent or take seconds; we will give reasonable advance notice for any planned maintenance expected to cause noticeable downtime.
7. Your data and content
You retain all rights to the content you and your forum users post. You grant BrynForum a limited licence to host, process, store, transmit, and back up that content solely to provide the Service.
We process personal data in accordance with our Privacy Policy. Where you (the Customer) collect personal data from your own forum's users, you are the data controller and we act as a data processor on your behalf.
You can request an export of your forum's database and uploaded files at any time by contacting us. We will deliver this within 14 days.
8. Termination
Either party may terminate the subscription at any time. On termination:
- The Service is suspended at the end of the current paid billing period;
- Your data remains accessible for export for at least 30 days after suspension;
- After 30 days we may delete your data permanently.
We may terminate immediately and without refund for serious or repeated breaches of these terms, illegal activity, or non-payment.
9. Limitation of liability
To the maximum extent permitted by law, BrynForum is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service.
Our total aggregate liability to you for any claim arising from the Service is limited to the amounts you have paid to BrynForum (via Lemon Squeezy) in the 12 months preceding the claim.
Nothing in these terms limits or excludes any liability that cannot be limited or excluded under the laws of England and Wales.
10. Changes to these terms
We may update these terms from time to time. Material changes will be notified to your account email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
11. Governing law and disputes
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising from or relating to these terms, except that nothing prevents us from seeking injunctive relief in any competent jurisdiction.
